AGSEM has signed a letter of agreement with McGill to preserve each invigilator's priority and their semesters worked towards their probation status as of April 30, 2020. Priority and probation status will be frozen from this date for one year, or until Invigilation jobs return to McGill. The agreement will be revisited if Invigilation positions have not returned by May 1st 2021.
The full text of the agreement is below.
WHEREAS the current circumstances related to COVID19 has resulted in the cancellation of
in-person exams due to the University’s campus closure, until further notice;
WHEREAS according to articles 13.01.01 iii) and 15.01, an Invigilator’s position in the priority
pool and probationary status may be impacted due to a prolonged absence from
work, which is out of their control;
WHEREAS the Parties wish to address the issue in an amicable manner;
The Parties hereby agree to the following:
1. The preamble forms an integral part of this agreement;
2. In the application of article 13.01.02iii) of the collective agreement, Invigilators will maintain their priority pool status from April 30, 2020, which is the last day of the winter 2020 final exam schedule, for a period of one (1) year;
3. In the application of article 15.01, a person that was appointed to an Invigilator position in the Winter 2019 and Fall 2019 academic terms and who was not appointed in the Winter 2020 academic term due to the current circumstances, will not be considered as having a break in their worked consecutive academic terms until the Employer resumes in person exams on campus;
4. In the application of article 15.01, a person that was appointed to an Invigilator position in the Fall 2019 academic terms and who was not appointed in the Winter 2020 academic term due to the current circumstances, will not be considered as having a break in their worked consecutive academic terms until the Employer resumes in person exams on campus;
5. This agreement will end on May 1st, 2021 and may be extended, by mutual agreement between the Parties;
6. The Union hereby acknowledges that, before having signed the present Agreement, it had
sufficient time to revise the terms and conditions contained therein;
7. The Parties acknowledge that this Agreement shall not constitute or be invoked as a precedent of any kind;
8. The Parties have expressly required that the present Agreement be drafted in the English
